Common questions about EB-2 / NIW — End-to-End (with Partner Attorneys)
What is the difference between EB-2, EB-2 NIW, and EB-3?
EB-2 is the employment green card for advanced-degree professionals or those with exceptional ability; it normally requires a job offer and PERM. EB-2 NIW (National Interest Waiver) lets you self-petition without an employer or PERM if your work benefits the national interest (the Dhanasar standard). EB-3 is for skilled workers and professionals and almost always requires an employer to sponsor with PERM.
Can I apply for EB-2 NIW without an employer?
Yes. The National Interest Waiver is one of the few employment green card categories where you can self-petition without a job offer or labor certification (PERM). Our licensed partner attorneys draft the I-140/NIW petition, and we prepare translations, credential evaluation, and the I-485 packet.
How much does EB-3 sponsorship cost in 2026, and who pays?
EB-3 involves PERM, I-140, and I-485 fees plus attorney fees. By law, the employer must pay certain PERM costs. Be cautious of agencies that "sell" EB-3 sponsorship. We have a full EB-3 cost guide in our resources.
